The United Nations Independent Expert on Sexual Orientation and Gender Identity is consulting on the topic of the human right to education and the protection against violence and discrimination based on sexual orientation and gender identity.

This Justice and Equity Centre submission focuses on the issue of discrimination against LGBTQ students, and the exceptions which allow religious schools to lawfully engage in this mistreatment. This includes exceptions to both Commonwealth (Sex Discrimination Act 1984) and NSW (Anti-Discrimination Act 1977) law, as well as to the laws of Western Australia and potentially South Australia.

The submission makes the case for urgent law reform to remove these exceptions and finally allow all students to learn and grow free from the fear of discrimination on the basis of their sexual orientation and gender identity.
