Submission to the Australian Human Rights Commission consultation into Current and emerging threats to trans and gender diverse human rights

PIAC’s submission to the Australian Human Rights Commission con into ‘Current and emerging threats to trans and gender diverse human rights’ focuses on three key issues:

  1. Birth certificate reform, including the need to update the Births, Deaths and Marriages Registration Act 1995 (NSW) to remove the requirement for trans and gender diverse people to undergo genital surgery to access updated birth certificates, and to allow options for gender markers other than male and female.
  2. Anti-discrimination and vilification reform, including the need to amend the Anti-Discrimination Act 1977 (NSW) to ensure non-binary people are protected against discrimination and civil vilification, and to protect trans and gender diverse students and teachers in religious schools against discrimination, as well as calling for the introduction of prohibitions on vilification on the basis of gender identity under the Sex Discrimination Act 1984 (Cth).
  3. Misgendering and deadnaming in criminal legal institutions, highlighting the adverse experiences of PIAC’s trans and gender diverse clients in relation to NSW Police, Corrective Services NSW and the Justice Health and Forensic Mental Health Network, including misgendering and deadnaming as well as segregation.
