Improving accountability around NDIS settlements

A key focus of our A Fairer NDIS work is on the publication of settlement outcomes following appeals to the Administrative Appeals Tribunal (AAT).

Currently, around 96% of cases before the AAT involving the National Disability Insurance Agency (NDIA) are finalised by settlement. However, these settlement outcomes are not made public.

PIAC is calling for the publication of this information to promote transparency, consistency and accountability around NDIA decision-making. The publication of this information will also assist people with disability in understanding the types of supports and funding that people in similar situations may be receiving. PIAC is advocating for this information be published in a de-identified way to protect the privacy of applicants.

A report released by the parliamentary Joint Standing Committee on the National Disability Insurance Scheme in December 2019 strongly supported the publication of this information in de-identified form.

PIAC is working with the NDIA to implement this recommendation.
